1. Security and Privacy Policy

1.1 Introduction

Welcome to TELMINS. We are committed to protecting your personal data and respecting your privacy. This Security and Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI-driven SaaS platform. This policy is designed to comply with the General Data Protection Regulation (GDPR) and other applicable global privacy frameworks.

1.2 Data Minimization

We adhere strictly to the principle of data minimization. We only collect the minimal amount of personal information necessary for the TELMINS platform to function effectively and to provide you with our AI services. We do not collect extraneous data that is not directly relevant to our service provision, in accordance with Article 5(1)(c) of the GDPR.

1.4 Information We Collect

Account Information includes your name, email address, billing information, and login credentials. This data is necessary to create and manage your account and to process payments.

Usage Data includes information about how you interact with our platform, such as log data, IP addresses, browser type, and device information. This data is collected to maintain platform security, diagnose technical issues, and improve user experience.

User Content refers to any data, text, files, or instructions you input into our AI tools for processing. This content is processed solely to deliver the requested AI-generated output to you.

1.5 Security Measures

We implement robust technical and organizational safeguards to protect your data against unauthorized access, alteration, disclosure, or destruction, in accordance with Article 32 of the GDPR. Our key security controls include:

  • All data is encrypted at rest and in transit using industry-standard SSL/TLS protocols.
  • Strict role-based access controls (RBAC) ensure only authorized personnel access sensitive data.
  • Regular security audits, including penetration testing and vulnerability scans.
  • Logging and audit trails to track how data is accessed and used within our systems.

1.6 Data Sharing and Third-Party Processors

We do not sell your personal data to any third party. We may share your data with trusted third-party service providers ("Sub-processors") who assist us in operating our platform. All Sub-processors are carefully vetted and are bound by strict Data Processing Agreements (DPAs). A list of our current Sub-processors is available upon request.

1.7 Data Subject Rights

1.8 Data Retention

We retain your personal data only for as long as is necessary to fulfill the purposes outlined in this policy, or as required by applicable law. Upon account termination, we will delete or anonymize your personal data within 90 days, unless we are legally obligated to retain it for a longer period.

2. User Profile Terms and Conditions

2.1 Introduction

These User Profile Terms and Conditions ("Terms") govern your access to and use of the TELMINS platform, including the creation and management of your user profile and account. By registering an account with TELMINS, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

2.2 Account Registration and Responsibility

To access our AI-driven services, you must create an account by providing accurate, current, and complete registration information. You agree to promptly update this information to keep it accurate throughout your use of the platform.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify TELMINS of any unauthorized use of your account at [email protected].

2.3 Acceptable Use Policy

TELMINS provides powerful AI tools intended for lawful, ethical, and productive purposes. The following behaviors are strictly prohibited:

  • Generating, uploading, or distributing any content that is illegal, harmful, defamatory, obscene, or that infringes upon intellectual property rights.
  • Attempting to reverse engineer, decompile, or manipulate the underlying AI models to bypass safety filters or circumvent usage restrictions.
  • Uploading or transmitting viruses, malware, ransomware, or any other malicious code.
  • Using the platform to send unsolicited commercial communications (spam) or to engage in automated data scraping without prior written consent.

TELMINS reserves the right to suspend or permanently ban any account that violates these rules, without prior notice or liability.

2.4 User Content and AI Interactions

You retain ownership of any data, text, files, or other materials you input into the TELMINS platform ("User Content"). By submitting User Content, you grant TELMINS a worldwide, non-exclusive, royalty-free license to use, reproduce, and process the User Content solely for the purpose of providing and improving our AI services to you. This license terminates when you delete your User Content or your account.

2.5 Disclaimers Regarding AI-Generated Output

Important Disclaimer: AI-generated outputs may contain errors, omissions, inaccuracies, or biases. You acknowledge and agree that you are solely responsible for reviewing, verifying, and thoroughly testing any output or "finished work" generated by TELMINS before relying on it, publishing it, or deploying it in any production environment. TELMINS expressly disclaims all warranties, express or implied, regarding the accuracy or completeness of AI-generated content.

2.6 Termination

You may terminate your account at any time by following the instructions in your account settings or by contacting our support team. TELMINS may terminate or suspend your access to the platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.

2.7 Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which TELMINS is headquartered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

3. Digital Products Terms

3.1 Introduction

These Digital Products Terms govern the purchase, licensing, and use of digital products — including AI-generated code, applications, websites, and other digital assets — produced by or through the TELMINS platform. By purchasing, accessing, or downloading any Digital Product from TELMINS, you agree to be bound by these Terms.

Digital Rights Management (DRM): TELMINS may employ DRM technologies to protect our intellectual property. You agree not to circumvent, disable, or otherwise interfere with any DRM mechanisms implemented by TELMINS.

3.3 Intellectual Property and Ownership

You retain full ownership of any original content, data, or intellectual property you input into the TELMINS platform. Unless otherwise stated in a specific enterprise agreement, you own the intellectual property rights to the final, AI-generated code and assets produced by TELMINS based on your inputs and instructions. TELMINS allows full code export of the applications and digital assets you create on our platform. You are free to host, modify, and deploy the exported code independently, without any vendor lock-in restrictions.

3.4 Refund Policy

Due to the inherent nature of digital goods, all sales of Digital Products are generally considered final and non-refundable once the product has been downloaded, accessed, or generated. However, TELMINS may grant a refund under the following exceptional circumstances:

  • A critical technical error on the TELMINS platform prevents you from accessing or downloading the Digital Product, and our support team is unable to resolve the issue within a reasonable timeframe.
  • The Digital Product contains significant defects that render it wholly unusable for its intended purpose, and these defects were not disclosed prior to purchase.

To request a refund, contact [email protected] within 14 days of the purchase date, providing detailed evidence of the technical failure or defect. All refund decisions are made at the sole discretion of TELMINS.

3.5 Limitation of Liability

To the maximum extent permitted by applicable law, TELMINS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to, use of, or inability to access or use the Digital Products.

4. Required Contracts

This section outlines the essential contracts governing the relationship between TELMINS and its business customers. These agreements are designed to ensure transparency, reliability, and full compliance with data protection regulations.

4.1 Service Level Agreement (SLA)

This SLA defines the expected performance standards, uptime guarantees, and support response times for the TELMINS AI platform. TELMINS guarantees a monthly uptime percentage of 99.9% for our core AI processing and platform access services. TELMINS will provide customers with at least 48 hours' advance notice of any scheduled maintenance.

If TELMINS fails to meet the 99.9% monthly uptime commitment, service credits may be applied to the next billing cycle:

4.2 Data Processing Agreement (DPA)

This DPA governs the processing of personal data by TELMINS (the "Data Processor") on behalf of the customer (the "Data Controller"), ensuring compliance with the GDPR, specifically Article 28. TELMINS processes personal data solely on the documented instructions of the Data Controller and for no other purpose.

In the event of a personal data breach, TELMINS will notify the Data Controller without undue delay and in any event within 72 hours of becoming aware of the breach. TELMINS will provide at least 30 days' notice of any intended changes to the sub-processor list.

4.3 Subscription Agreement

Subscriptions are billed in advance on a monthly or annual basis. Unless otherwise specified, subscriptions automatically renew at the end of each billing cycle. TELMINS will send a renewal reminder at least 30 days before the renewal date for annual subscriptions.

You may cancel your subscription at any time through your account settings or by providing written notice to [email protected]. Cancellation will take effect at the end of the current billing cycle. TELMINS will provide at least 30 days' written notice of any material changes to the service or fee increases.
